Why Join VIADA?
VIADA provides benefits & services to members they are not always able to find on their own. With VIADA the dealer has educational and networking opportunities through our schools, workshops, town hall/district meetings, and annual convention and trade show.
Whether it’s creating an environment for sharing ideas, or serving as a place to come to for solutions to problems that arise, VIADA is the only organization in Virginia whose primary purpose is the welfare and success of the independent dealer.

Mission Statement

To inform, educate, and represent motor vehicle dealers in all forums, and to work in cooperation with other organizations to make the Commonwealth of Virginia a safer community for all.

Clarified legislative language to allow independent dealers to buy and sell used motorcycles, motor homes and trailers with no additional licensing fee or $25,000 bonding requirement – VIADA INITIATIVE

Allow dealers to use their tags to demo vehicles on consignment from other dealers – VIADA BILL

Allow rental dealers to retrieve their vehicles that have been impounded without having to go through the courts – VIADA AMENDMENT
 

1997

Allow part time employees to use a D tag when transporting a vehicle - permit good for 24 hours – VIADA BILL
 

1998

Exempt charities from having a dealer’s license if they accept donated vehicles – VIADA AMENDMENT limited to 12 vehicles per year and charity must be registered with the MVDB.
 

1999

Raised storage lien from $300 to $450 and mechanics lien from $500 to $750 – VIADA AMENDMENT kept storage lien at $300 and raised mechanics lien to $650

Allow processing fee to be that which is agreed upon by both buyer and seller and subject to Sales and Use Tax VIADA SUPPORTED

Require a lien holder to be notified if a vehicle is to be sold for delinquent taxes – VIADA SUPPORTED
 

2000

Allow insurance company to apply for an unbranded title if stolen vehicle is recovered without major damage – VIADA SUPPORTED
 

2003

The Governor’s budget stripped all the money out of the Recovery Fund – VIADA INITIATIVE was able to save $250,000; thereby, eliminating the need for a dealer assessment.
 

2004

Raised mechanics lien from $625 to $1,500 VIADA AMENDMENT raised to $750

DMV Manual $15 Transaction fee to start at first transaction – VIADA AMENDMENT moved to 20 transactions before fee.
 

2005

Allow dealer to transfer customer’s plates if title is not present – VIADA BILL

Require applicant independent dealers to satisfactorily complete a course of study. – VIADA BILL

DMV to allow the use of the supplemental reassignment form without first completing all reassignment sections on the title – VIADA INITIATIVE

Worked with DMV on changes to the temporary tag procedures including allowing the issuing of a third set of tagsVIADA INITIATIVE

DMV approved the process to allow dealers to title a vehicle in the dealership’s name on-lineVIADA INITIATIVE

A dealer-operator member was sited by a state trooper for personal use of a dealer tag in Stafford County. Others had been previously convicted of the same offence in the County’s District Court. VIADA’s attorney, at the request of the Association, successfully represented the member and convinced the Court that Dealers, Dealer-operators and their spouses, salespersons and employees of the dealer are allowed personal use of a dealer tag under existing Virginia Code. – VIADA INITIATIVE.

Allow exempt odometer brand on foreign titles to be carried forward on VA titles – VIADA BILL
 

2008

Major curbstone bill - created an entire new section in the Code – VIADA SUPPORTED
 

2009

Allow Virginia dealers to process an out-of-state title with an affidavit of repossession attached – VIADA BILL
 

BILLS DEFEATED BY VIADA
 

The following bills were introduced in the Virginia General Assembly over the last several years that VIADA opposed and were defeated, amended, or withdrawn by the bill’s patron.
 

  • Increase Sales and Use Tax from 3% to 5%

  • Raise minimum insurance limits on tow trucks to $750M

  • Raise minimum liability limits on vehicles to $50/100/20

  • Disclose damage to a vehicle in excess of 25%

  • Require all drivers to carry proof of insurance including prospective customers on a demonstration ride

  • Allow unlicensed persons to negotiate a sale

  • Allow safety inspection stations to set their fees

  • Require a dealer to provide customers with their local’s personal property tax form

  • Cap a dealer’s processing fee at $25

  • Misrepresentation of rental car availability added as an offence under the Consumer Protection Act

  • Changes the penalty for a dealer who refused to allow access to their records from a civil penalty to a Class 1 misdemeanor

  • Transfer responsibility for state inspection from the State Police to DMV

  • Prohibit AS IS sales

  • On the regulatory side; DMV’s move to issue all titles out of Richmond headquarters

  • A used car lemon law

  • Prohibit all personal use of “Dealer Tag”

  • A requirement for all dealers to post a $25,000 bond after their first three years

  • Notify DMV of all vehicles purchased or traded

  • Post a list of all “Known Mechanical Defects” on all vehicles

  • Furnish titles within two days in wholesale transactions
