EFFECTIVE JULY 1, 2010.
Paragraph 9, on the back of the VIADA Buyers Order will include the new language mandated by the 2009 General Assembly. VIADA anticipates this re-write to be available to its members by January 2010. The law states both the current language and new language may be used at this time.

How does an As-Is sale become a Warranty sale?
Sell a vehicle As-Is and then make repairs for no charge to the customer OR warranty the engine and do a repair on the air conditioner. This is where you use the “VIA 18 – Goodwill Repair Form” because without it the As-Is sale becomes a warranty sale and the air conditioner is now part of the warranty. It’s further complicated because in both cases there is no time limit to the warranty expiring.

The new Affidavit of Repossession law does not allow out-of-state dealers to process titles in Virginia with this document. The law is only intended to benefit Virginia dealers. Therefore, out-of-state dealers selling to Virginia consumers must give them a free and clear title.
